Limited Lifetime Product Warranty

1. Warranty Coverage
​
A Bright Idea Lighting (ABI) ("Company") hereby warrants that the EverLights permanent holiday lighting (the "Product") is free from defects in materials and workmanship under normal use and service for the lifetime of the original purchaser ("Customer").
​
2. Warranty Period:
​
The lifetime warranty begins from the date of purchase by the original Customer and continues for the duration of the Customer's ownership of the Product.
​
3. What is Covered?
​
ABI warranty is void if the EverLights Product is not used or handled as the EverLights Product is intended to be used or handled.
EverLights Products – specifically EverLights LED lights – are intended to be installed specifically using EverLights components, including the EverLights Bridge, EverLights Wireless Receiver, EverLights Power Booster (5v), EverLights Classic Power Booster (24v), EverLights Data Buffer, EverLights Unlit Wire – Color changing (4 wire), EverLights Unlit Wire – Class (2 wire), EverLights Butt Splices Heat Shrink Connectors, and EverLights Y Heat Shrink Connectors (collectively, the “EverLights Components”). In the event EverLights Products are installed without using EverLights Components, then any applicable EverLights warranty, as provided herein, shall be fully void.

4. Warranty Claim Procedure:

In the event of a warranty claim, the Customer shall:
​
4.1. Contact A Bright Idea Lighting at 727-683-6606 to report the warranty claim within thirty (30) days after discovering the problem, failure, or defect.
​
4.2. Describe the nature of the defect and provide any requested information or documentation to assess the warranty claim.
​
4.3. To fully evaluate the claim, ABI may ask you to provide, at your expense, pictures of your EverLights and/or samples for ABI to see and test. To the extent ABI requires additional information, it will provide you with instruction on what is necessary to evaluate the claim. 5. Warranty Exclusions:
​
As provided above, this limited warranty does not cover any labor for installation or otherwise. Furthermore, in addition to events voiding this warranty as provided herein, this limited warranty does not cover damage to EverLights products due to any cause or condition beyond EverLights’ control. Examples include, but are not limited to the following:

Damage resulting from misuse, neglect, accident, or improper maintenance.

Normal wear and tear.

Modifications or alterations to the Product not authorized by A Bright Idea Lighting.

Any non-original components or parts not supplied by EverLights or A Bright Idea Lighting.

Damage or loss of EverLights as a result of failure of roof, gutter, soffit, etc…

Wind damaging home and thus EverLights.
-
Sun or UV rays fading or discoloring product.
-
Acts of God, accidents, fire, or floods.
-
Over tightening a cap beyond “finger tight” and causing the post to break off.

Objects or persons striking home and thus EverLights
-
Improper or faulty installation.
-
Damage or loss due to improper power flow throughout the home or to the EverLights Product.

Inadequate gutter or roof drainage.
-
Altering the product outside of intended use as advertised by EverLights.
-
Neglect or abuse by the Covered Owner or any other third-party, including but not limited to invitee, licensee, or assignee.

Leaks caused by pre-existing conditions or structural failures on the property.
-
Any costs incurred which were not previously authorized by EverLights in advance.
In addition to the above, any compensation offered by EverLights will not cover any physical damage to the property, including but not limited to the surface of which EverLights Products were installed.

6. Remedies:
​
6.1. In the event that a defect is confirmed, A Bright Idea Lighting will, at its discretion, repair or replace the defective Product.
​
6.2. Any repaired or replaced Product will be covered by the remaining term of the original warranty.
​
7. Limitation of Liability:
​
The remedies provided in this warranty are the sole and exclusive remedies for a breach of this warranty. A Bright Idea Lighting shall not be liable for any incidental, consequential, or indirect damages, or loss of profits.

8. Transferability:
​
This warranty is non-transferable and applies only to the original Customer.
​
9. Applicable Law:
​
This limited lifetime warranty shall be governed by the laws of Florida without regard to its conflict of laws principles.

By purchasing the Product, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions of this limited lifetime warranty.

Installation Warranty
1. Warranty Duration:
​
The Contractor warrants that all installation work ("Work") performed under this contract shall be free from defects in workmanship and materials for a period of 2 years from the date of completion and acceptance, unless otherwise specified in this contract. After the 2 year warranty period a trip charge and minimal labor fee may charged but the warrantied component will be replaced.

2. Scope of Warranty:
​
The installation warranty covers the repair or replacement of any components, materials, or work found to be defective during the warranty period. This warranty specifically includes but is not limited to; EverLights Products – specifically EverLights LED lights – are intended to be installed specifically using EverLights components, including the EverLights Bridge, EverLights Wireless Receiver, EverLights Power Booster (5v), EverLights Classic Power Booster (24v), EverLights Data Buffer, EverLights Unlit Wire – Color changing (4 wire), EverLights Unlit Wire – Class (2 wire), EverLights Butt Splices Heat Shrink Connectors, and EverLights Y Heat Shrink Connectors (collectively, the “EverLights Components”).

3. Exclusions:
​
This installation warranty shall not apply to defects or issues arising from:
​
a. Normal wear and tear.
b. Accidental damage or misuse.
c. Unauthorized modifications or repairs.
d. Failure to follow maintenance and care instructions provided by the Contractor.
e. Acts of nature, including but not limited to floods, earthquakes, or severe weather conditions.
4. Warranty Claims:
a. To make a warranty claim, the Client shall promptly notify the Contractor in writing of the alleged defect during the warranty period.
b. The Contractor shall have the right to inspect and verify the alleged defect before authorizing any repair or replacement work.
c. If a defect is confirmed, the Contractor shall undertake the necessary repair or replacement at its own cost, including labor and materials.

5. Remedies:
​
In the event of a valid warranty claim, the Client's sole and exclusive remedy shall be the repair or replacement of the defective work. The Contractor shall not be liable for any consequential or incidental damages arising from the defect.

6. Limitation of Liability:
​
The Contractor's liability under this installation warranty is limited to the cost of repairing or replacing the defective work and does not extend to any other losses or damages, whether direct or indirect.
​
7. Transferability:
​
This installation warranty is non-transferable to subsequent owners of the property where the installation work was performed.
​
8. Governing Law:
​
This installation warranty is governed by the laws of Florida, and any disputes related to this warranty shall be resolved in accordance with the dispute resolution provisions of the main contract.
